1. Preamble

These General Terms and Conditions of Sale (hereinafter referred to as "GTCS") define the rights and obligations of the company SILVERED CORPORATION and its customers concerning the sale of products offered on the main Website www.vivibrands.fras well as on its domains redirecting to this Site (see section 2. Applicability).

By placing an order, the customer unreservedly accepts these GTCS as well as the Website's legal notice and privacy policy.

Languages available : French, English, Spanish, Italian, Chinese, German and Dutch.
Default currency : euro (€), with the option of choosing another currency depending on the user's region.

These General Terms and Conditions of Sale (the "GTCS") apply to :

3.1. Product description

The products offered are accurately described. However, slight variations in colour or texture may occur due to the technical characteristics of the screens or manufacturing processes.

3.2. Product availability

All products are subject to availability. In the event of unavailability after an order has been placed, the customer will be informed as soon as possible and will be able to choose between :

  • Replacement with an equivalent product.
  • A full refund of the amount paid.

4. Prices and payment

4.1. Rates

Prices are displayed in euros (€), inclusive of all taxes. If another currency is selected, the amounts are converted according to the current exchange rates. Delivery costs are specified before the final validation of the order.

4.2 Accepted means of payment

The following methods of payment are accepted:

  • Credit/debit cards: Visa, Mastercard, American Express, Carte Bancaire (CB).
  • Local banking services: Bancontact, EPS, iDEAL, Przelewy24 (P24).
  • Digital payments: Apple Pay, Google Pay, PayPal.
  • Payment in instalments: Klarna (subject to availability).

Payments are processed via secure platforms that comply with PCI-DSS standards. No banking data is stored by SILVERED CORPORATION.

5. Order process

5.1. Ordering steps

  1. Customers select the products they want and add them to their basket.
  2. They choose the options (size, colour, etc.) and validate their basket.
  3. Customers enter their personal details and choose their method of payment.
  4. An order confirmation will be sent by email.
 

5.2. Refusal of order

SILVERED CORPORATION reserves the right to refuse any order for legitimate reasons, in particular in the event of :

  • Ongoing payment dispute.
  • Suspicion of fraud.

6. Delivery

6.1. Delivery methods and times

Orders are dispatched after a preparation period (usually 24 to 48 hours). Available delivery options include:

  1. Standard delivery (4-8 working days)
  2. Fast delivery (3-5 working days)
  3. Express delivery (2-3 working days)
 

Delivery times may vary according to destination and transport conditions.

6.2. Rates and service areas

Delivery costs are indicated before payment. For orders outside the European Union, customs duties may be applied by the local authorities and are payable by the customer. These costs cannot be estimated or managed by ViviBrands, as the order is dispatched directly by the various suppliers.

7. Right of withdrawal and returns

7.1. Right of withdrawal

In accordance with European Directive 2011/83/EU, you have a period of 14 calendar days from receipt of your order to exercise your right of withdrawal without having to give any reason.

To exercise this right, use the contact form available on our Site and select the reason "return". Once your request has been validated, you will receive the necessary instructions by email.

7.2. Return conditions

Returned products must meet the following criteria:

  • Be in their original condition: unworn, unwashed, with their labels.
  • Be accompanied by proof of purchase.

Personalised or made-to-measure products are not eligible for return, except in the case of defect or non-conformity.

7.3. Return costs

  • The cost of returning goods is borne by the customer, except in the event of an error attributable to ViviBrands.
  • Credit note for return postage : We offer a credit note of up to €20 (incl. VAT) to cover all or part of the return costs, subject to the conditions detailed on our website. page dedicated to feedback and exchanges.
 

7.4. Refunds

After receipt and inspection of the returned items, the refund will be made within 7 to 14 working days, depending on the original method of payment.

8. Legal warranties

Products sold by ViviBrands are covered by the legal guarantees provided by French law:

  • Legal guarantee of conformity : (articles L217-4 et seq. of the French Consumer Code) in the event that the product does not conform to the order.
  • Hidden defects guarantee : (articles 1641 et seq. of the French Civil Code) for any defect rendering the product unfit for use.

9. Liability

SILVERED CORPORATION shall not be held liable:

  • Site interruptions or malfunctions.
  • Indirect damage resulting from the purchase or use of the products.
 

However, we are liable in the event of gross negligence causing direct damage.

These GCS are governed by French law.

11.2. Resolution of disputes

  • For customers located in the European Union: any dispute will be submitted to the competent jurisdiction of the consumer's country, in accordance with Regulation (EU) No. 1215/2012.
  • Customers outside the European Union: any dispute shall be subject to the exclusive jurisdiction of the courts of the place where SILVERED CORPORATION's registered office is located.

12. Modification of the GTCS

SILVERED CORPORATION reserves the right to modify these GTC at any time. The applicable GTCS are those in force on the date of the order.
